eignaPost terms of service
1. The service
OT AI ehf., Icelandic company registration no. 671113-1520, provides eignaPost. References to “OT AI” in these terms mean OT AI ehf. eignaPost is a digital worker that receives emails from the customer, prepares draft posts for Facebook and Instagram using the customer’s registered brand settings, sends the drafts for approval and publishes them to social media accounts owned by the customer.
No post is published without approval from someone at the customer’s organisation. This is a permanent part of the service and will not be disabled.
These terms apply alongside the service agreement and data processing agreement that the customer accepts or signs. In the event of a conflict, the service agreement takes precedence.
2. Customer responsibilities
The customer is responsible for the content they submit and the content they approve for publication. Specifically:
- They own or have permission to use all text and images they submit, including the necessary copyright permissions and permission to publish images of people.
- The content is accurate, is not misleading and complies with Icelandic law, including legislation on real estate transactions and the supervision of commercial practices and marketing.
- The content complies with Meta’s content and advertising terms.
- They own the Facebook Page and Instagram account on which content is published, or have written permission from the owner.
- They keep the staff directory up to date and notify us when an employee leaves.
- They protect access to the dashboard and do not share it with unauthorised people.
Drafts are written by AI and may contain errors. The person approving a draft is responsible for reviewing it. Approval constitutes confirmation that the content is accurate.
3. What OT AI guarantees
We work to keep the service available and to publish approved content without changes. We do not guarantee uninterrupted operation.
4. Limitation of liability
OT AI is not liable for:
- Service disruptions, changes or shutdowns at Meta or other third parties.
- Meta restricting or closing the customer’s account.
- Content that the customer has approved for publication.
- Indirect loss, including loss of business, revenue, reputation or data.
OT AI’s total liability for direct loss attributable to the service is limited to the amount the customer actually paid for the service during the three months before the event giving rise to liability.
This limitation does not apply to intentional misconduct or gross negligence, or to liability that cannot be limited by law.
5. Right to suspend the service or revoke access
OT AI may suspend the service or revoke access, in whole or in part, if:
- The customer breaches these terms or the service agreement.
- A payment is overdue.
- Submitted content is unlawful or breaches Meta’s terms.
- Meta requires us to do so or revokes our access.
- Use of the service threatens its security or operation.
Where possible, we notify the customer before a suspension. Where the law or Meta’s terms require immediate action, we may suspend the service without notice.
The customer may cancel the service in accordance with the service agreement. We delete their data in accordance with the privacy policy.
6. Intellectual property
The customer retains ownership of the content they submit and the posts that are published. OT AI owns the service itself, its software and the methods behind it.
7. Changes to these terms
We may change these terms. We notify the customer of changes by email 30 days in advance. If the customer continues to use the service after a change takes effect, they are deemed to have accepted it.
8. Disputes
These terms are governed by Icelandic law. If a dispute arises, the parties first try to resolve it through discussions within 30 days. If they cannot resolve it, the dispute must be brought before the Reykjavík District Court.
